Lead paint is present in the majority of pre-1978 NYC residential buildings. Renovation, repair, and painting activities that disturb lead-based paint (LBP) create lead dust that workers inhale and inadvertently ingest. Lead is a neurotoxin with no safe level of exposure. Long-term lead exposure in construction workers causes brain, kidney, and reproductive damage that develops silently over years of work.

  • Three agencies enforce lead paint rules in NYC construction. A single project can be cited by OSHA, EPA, and NYC simultaneously
  • Most common NYC violation: dry sanding or grinding LBP without HEPA collection or containment
  • Workers who are asked to sand, grind, or demolish painted surfaces in pre-1978 buildings have the right to know the lead content of the paint — ask the GC for the XRF or sampling report
